1. Scope

 

1.1 Our following Terms and Conditions (or also referred to as Auction terms) apply to all legal transactions between Historical Treasures, Unipessoal, Lda. (hereinafter Historical Treasures) and the customer in the context of participation in the auctions on the auction platform biddr.com.

1.2 The following terms and conditions shall apply to future contracts between the Parties even without written agreement in the case there has not been a different written agreement between the Parties.

 

 

2. Evaluation and authenticity of coins

 

2.1 All coins are valued by Historical Treasures before they are put up for sale at auction. The description is done to the best of Historical Treasures’s knowledge by thoroughly investigating the item according to the prevalent opinion of experts in the field at the time of selling.

2.2 All coins are guaranteed to be genuine unless specifically stated otherwise in the lot description. If a sold coin on auction is determined a forgery buy a recognized expert in the field, the coin be returned and the full amount is refunded.

 

 

3. Description of coins (Including photography)

 

3.1 Coins up for auction are presented with photographs and descriptions on https://www.biddr.com. The description is described according to the best of Historical Treasures’s knowledge and based on detailed research in accordance with the prevailing views among experts at the time of sale. Historical Treasures reserve the right to make changes until the actual auction.

3.2 No guarantee is given that the texts and pictures portrayed on the internet are correct, complete and up-to date. Printing errors and mistakes can occur and Historical Treasures reserve the right to correct them.

3.3 Historical Treasures does its best to make sure that the photos of the coins reflect the optimum depiction of the coin. Photographs are made in lighting that enables toning contrasts of the coins to be visible and most optimum. Coins can therefore look different in light when received. Historical Treasures cannot be blamed for difference in lighting of the actual coin compared to the photography.

3.4 All coins in our Auctions can be examined and inspected before the auction at our offices only by appointment.

 

 

4. Purchase/Order

 

4.1 Participation in the auction is only permitted to customers who have previously registered for the auctions of Historical Treasures on the platform biddr.com.

4.2 By registering for our auctions on the biddr.com platform and by placing a bid, you accept our Terms and Conditions and those of the biddr.com platform.

4.3 The purchasing process through the auction platform biddr.com involves three to four steps in total. In order to register one needs to make his or her customer data known, including billing address, and in case it differs from the billing address, also the shipping address. Furthermore, a password must be selected which in addition to an email address will be used as login on the portal. Next step is to login to the portal by typing in email and corresponding password. The third step is bidding on the wanted item(s). In case of being the highest bidder at the end of the auction a binding offer to conclude the contract will be issued. In the fourth step a method of payment is chosen. In the last step, there is the chance to check personal details again (e.g. Name, address, method of payment, items ordered, etc.) and correct them in the case something is incorrectly stated, before the order is shipped by Historical Treasures.

4.4 The customer is personally liable for the provision of the hammer price and cannot claim to have bought for the account of a third party.

4.5 We have the right to exclude people from participating in the web auction, at our discretion, without stating the reasons.

 

 

5. Bidding

 

5.1 The currency used while the auctions take place is EURO. Only bids in whole numbers are possible.

5.2 It is the bidder's responsibility to inform in due time of the technical requirements and requirements of the auction platform and to make any necessary installation and adjustments. Any liability of the Historical Treasures for damage caused by interruptions or delays due to technical defects shall be excluded.

5.3 Each submission of a bid is a binding offer, which cannot be withdrawn; the bidder remains bound by his bid until this is either outbidden or rejected by the Historical Treasures.

5.4 The minimum bid is the starting price. The Historical Treasures reserves the right to reject bids without providing reasons, to define bids and minimum bids as well as to change the time sequence of the auction. In addition, in the case of uncertainties, the Historical Treasures is entitled to call out lots and to withdraw lots.

5.5 Bids are only possible up to the end of the bidding. Subsequent bids cannot be considered. Time delays may occur due to electronic transmission and therefore bids must be rejected as delayed if they are issued shortly before the expiration time, but are only received thereafter by the Historical Treasures.

5.6 It is possible to bid online either by Proxy, Prebid or Live during the auction.

5.7 The bidding steps are as follows:

6. Amounts added to the hammer price

 

6.1 In addition to the hammer price the buyer pays a buyer's premium for the individual items as well as other amounts (shipping, insurance) described below if the conditions for these are applicable.

6.2 The total amount that the buyer pays to Historical Treasures (including shipping and insurance) is called the "purchase price".

6.3 Buyer’s Premium: In addition to the hammer price there must always be paid a Buyer’s Premium fee. The fee is 15.50% of the hammer price (VAT included).

6.4 This premium is not included in the final auction bid.

 

 

7. Payment

 

7.1 After the auction closes, the user will receive, as soon as possible, a statement of account summarizing the lots won and the added costs.

7.2 Payment for awarded lots is due immediately upon receipt of the auction statement of account.

7.3 As soon as the amount to be paid is finally credited to the Historical Treasures bank account, an invoice/receipt will be sent to the customer by email and in 3 business days the shipment is sent.

Credit card payments are not accepted.

All fees for bank transferring payment and other payment method are paid by the buyer.

 

 

9. Delivery and shipping conditions

 

9.1 All shipments are made from Portugal. We are not responsible for any taxes or duties levied on shipments to destinations outside of the European Union.

9.2 The delivery of goods shall be made by shipping to the delivery address provided by the customer, unless otherwise agreed. When processing the transaction, the delivery address specified in the Seller's order processing shall be decisive. Deviating from this, if the payment method PayPal is selected, the delivery address deposited by the customer with PayPal at the time of payment shall be decisive.

9.3 All shipments are mandatory insured.

9.4 All shipments are made through CTT Expresso and can be tracked in the following link:

9.5 Historical Treasures does not chip to:

  • Countries where postal services are provided at a low level;
  • Failed states;
  • States affected by hostilities.

9.6 Shipping costs

  • European Union:

CTT Expresso, (International Priority, Tracked and Insured): 25.00 EUR

  • USA:

CTT Expresso, (International Priority, Tracked and Insured): 35.00 EUR

  • Rest of the World:

CTT Expresso, (International Priority, Tracked and Insured): 25.00 EUR

  • Portugal:

CTT Expresso, (Priority, Tracked and Insured): 15.00 EUR

 

 

10 Returns

 

10.1 The customer has 15 days, counted from the date of receipt of the order, to make the return.

10.2 Returns must be requested for the following email address: biddr@historicaltreasures.pt

10.3 Returns of items will only be made in perfect condition.

10.4 The delivery of the items will be the responsibility of the customer and the shipping address of the goods will be sent in the return authorization.

10.5 The amount paid by the same method you used to make the payment will be refunded.

 

 

11 Data protection clauses / Data protection and security

 

We collect, store and process data within the scope of the statutory provisions for the initiation, conclusion, processing and repackaging of a sales contract. When visiting our website, the IP address, date and time, the type of browser and the operating system of your PC, as well as the pages you are looking at, are logged. Conclusion on personal data is not possible and not intended. The personal data you provide to us e.g. via order or email (for example your name and contact details) will only be processed for correspondence with you and only for the purpose for which you provided us with the data. We only pass on your data to the shipping company commissioned with the delivery as far as this is necessary for the delivery of the goods. In order to process payments, we will pass on your payment data to the credit institution which is responsible for the payment. We assure that we do not pass on your personal data to third parties, unless we are legally obliged to do so or you have expressly given us prior consent. If we use third-party services for the execution and processing of processing processes, the provisions of the Data Protection Law are complied with.

Personal data that has been communicated to us through our website will only be stored until the purpose for which they have been entrusted to us is fulfilled. Where trade and tax retention periods are to be observed, the duration of the storage of certain data may be up to ten years. If you no longer agree to the storage of your personal data, or if this has become incorrect, we will, upon appropriate instructions, make the deletion, correction or blocking of your data within the framework of the legal provisions. 12 Final Dispositions

 

In case of violation of these Terms and Conditions, we reserve the right to exercise any and all legal action. In addition, we reserve the right to, at its own discretion, cancel your account, with or without notice to you.

These Terms and Conditions and any separate agreement under which we provide you the Products/Services shall be governed by and construed in accordance with the laws of Portugal.

In accordance with Law No. 144/2015 of September 8, we inform you that in case of dispute, you, the consumer, may appeal to the Consumer Conflict Arbitration Center of the District of Coimbra, with head office at Avenida Fernão de Magalhães, no. 240, 1 floor, 3000-172 Coimbra, Portugal and with the following website: https://cacrc.pt/

Decree-Law No. 74/2017, of June 21, regulated by Ordinance No. 201-A/2017, established the creation of an online Complaints Book, available at https://www.livroreclamacoes.pt/Inicio/ (Digital Platform), which allows consumers and users, among other tools, to submit complaints in a dematerial mannerized, with the same value as complaints submitted in physical format.

If any terms described herein is found to be unlawful, void, or for any reason unenforceable, such terms shall be eliminated or reduced as provided by law, without affecting the validity and enforceability of other terms.

We reserve the right to change these Terms and Conditions without notice. The User is restricted to the version of the Terms and Conditions at the time of its use, so we recommend that you periodically check it.
